Terms of Service
These terms govern the use of EvidencePass. The service is intended for businesses (economic operators), not consumers. By ordering or using the portal, you accept them.
What EvidencePass is
EvidencePass is a technical tool that extracts values for the mandatory fields of the battery passport under Regulation (EU) 2023/1542 from your uploaded documentation, recording for each value which document, page and position it was found at. The output is an evidence map and, on request, a statement you can attach to your technical documentation.
What EvidencePass is not
We are not a notified body and do not issue certificates of conformity with the regulation. Our findings do not replace assessment by a competent authority, customs, or a notified body. Whether the evidence for a given field is sufficient remains for you, as the economic operator, and the competent authority to determine.
Current legal status of the rule set
The rules we assess documentation against are built directly from the official text of Regulation (EU) 2023/1542 and related acts, but carry draft status until legal review is complete. This is stated explicitly on every page where it matters.
Ordering and payment
Prices shown exclude VAT; Stripe calculates this based on the buyer's country and status. Payment is processed by Stripe; we never see or store your card details. After successful payment, you receive a sign-in link to the portal, where you upload your documentation.
Your documentation
Documents you upload remain your property. We use them solely to build your evidence map and do not share them with third parties other than the service providers listed in our privacy policy who help us run the service. You are responsible for having the right to share the content of documents you upload.
Limitation of liability
We perform the service with professional care, but do not guarantee that your documentation will satisfy market surveillance or customs review — that depends on the content of your documents and the judgment of the relevant authority, not on us. Liability for indirect damages is excluded to the extent permitted by law.
Refunds
Because the service begins immediately on payment (document processing), we do not offer a blanket automatic refund. If you believe the service clearly was not delivered as described, write to hello@evidencepass.com — we handle each case individually.
Governing law
These terms are governed by Slovenian law. Disputes fall under the jurisdiction of the courts of Maribor, Slovenia, unless mandatory law provides otherwise.
